Estate Disputes & Family Provision Claims

Discreet, respectful mediation for sensitive family matters

The death of a loved one can be one of life’s most difficult experiences. Unfortunately, it can also bring with it disagreements about how an estate should be managed or distributed. These disputes are often emotionally charged and can put significant strain on family relationships.

Mediation offers a respectful, cost-effective way to resolve estate disputes without the stress and expense of going to court. With sensitivity and professionalism, I assist families, executors, and beneficiaries to find practical solutions while preserving dignity and, where possible, family relationships.

Family Provision Claims (Succession Act 2006 (NSW))

The Succession Act 2006 (NSW) allows certain people to make a claim if they believe they have not been adequately provided for in a Will. These matters can be highly sensitive, particularly when close family members feel excluded or overlooked. Through mediation, I help families explore fair and workable outcomes, keeping the focus on resolution rather than conflict.

Executor & Beneficiary Disputes

Executors carry the responsibility of administering the estate, which can sometimes lead to disagreements with beneficiaries. Whether about the timing of distribution, the management of assets, or questions of transparency, these disputes can quickly escalate.  Mediation provides a confidential forum for all parties to be heard, easing tensions and working towards practical solutions without prolonged litigation.

Blended Family Disputes

Modern families are often complex, and disputes can arise between children from previous relationships, current partners, and extended family members. These conflicts can be particularly painful.  My mediation process allows all parties to discuss their concerns openly, with the aim of reaching an agreement that is both legally sound and respectful of the family’s unique circumstances.

Testamentary Challenges

Questions about the validity of a Will such as concerns about capacity, undue influence, or proper execution, are some of the most difficult estate disputes.  In these cases, mediation provides an opportunity to consider options for settlement and avoid the uncertainty, cost, and emotional burden of court proceedings.

A Sensitive, Respectful Approach

I understand that estate disputes are not only about money or property; they are about family, relationships, and the memory of loved ones. My role as mediator is to provide a safe, balanced environment where parties can work through their differences and reach resolution with dignity.

If you are facing an estate dispute or family provision claim, mediation may help you find a constructive path forward.
